This story has had so much press since the lawsuit was filed and continuing now that her suit was dismissed. It is sad that the vast majority of the public agrees she was wronged, but those responsible remain unaccountable.

Sometimes justice falls short. Dasha Fincher's case was dismissed and she received nothing after spending 94 days in jail for cotton candy. Monroe County and the deputies were dismissed based on sovereign immunity. Sirchie, who made the drug test kit, was previously dismissed before we could conduct discovery. Now we know that the deputy misread the test results based on Sirchie's confusing instructions and a lack of training. Still, Dasha got nothing. I am grateful that she was given a chance to share her story. Millions worldwide heard what happened to her and agreed she was wronged. Judge Self agreed that this never should have happened to her. But, the law just wasn't on her side.

We have heard from multiple clients asking how the Stay in Place order effects their child custody and visitation. Gov. Kemp issued clarification on this issue. You still have to exercise visitation even during a pandemic. Of course, parents may usually discuss and agree to alter visitation should they choose. Several clients were able to find compromises that worked for them. Without such an agreement, the existing order must be followed. Governor Kemp issued the below executive order on April 3, 2020 that no provision of the executive order shall limit, infringe, suspend, or supplant any judicial order, judgement, or decree, including custodial arrangements, nor shall any person use the executive order as a defense to an action in violation of a judicial order, judgement, custodial arrangement, or decree.
