We have been carefully following Senate Bill 415. This bill changes over 15 areas of law, but was sent to the insurance committee (non-lawyers), where it passed. It will now be voted on the floor of the Senate early next week. This bill, contrary to what is being advertised by legislators WILL NOT help small businesses. Should this pass, insurance premiums will skyrocket. This bill will hurt our veteran military retirees. Tragically this bill will protect drunk drivers, ...hotel operators that allow sex trafficking, big insurance, and will punish victims including the elderly and veterans. We ask you to contact your two personal Senators and any other Senator with whom you have an existing relationship, asking them to VOTE NO on SENATE BILL 415. In crafting your message, you may wish to mention the following generalized points: Senate Bill 415 was born out of an attempt to hide its very provisions from the Senate Judiciary Committee, whose members would be in the best position to debate and vet the bill, its application, and its true ramifications on everyday Georgians. While seeking to drastically change our legal system and its administration, the bill was sent to the Insurance Committee without a single lawyer member. Senate Bill 415 tilts the scales of justice in favor of big Insurance Companies, allowing them to make more and more profits without reducing a single premium for everyday Georgians. Senate Bill 415 prevents Judges from having the discretion to do the right thing in cases based on the facts and circumstances of each individual case Senate Bill 415 would limit a Georgian’s Constitutional rights to hold accountable in a civil court of law those who might harm your loved ones instead protecting drunk and negligent drivers Senate Bill 415 would protect corporations who carelessly and knowingly introduce poisonous products to our children and families Senate Bill 415 even prevents property owners from consequences from sex traffickers on their premises when the owner should have known about the activities instead allowing them to profit from the profits of the sex trafficking trade. Georgia Senate Bill 415 Hurts Veterans. Rarely do I post information on social media, but the import of defeating this bill is tantamount to an absolute crisis. Full disclosure, I am a trial lawyer and I represent the victims and families of those who’ve been injured or killed by the negligence of another. I am proud of what I do and have no reservations in saying so. Even if I weren’t a trial lawyer, as a conscientious citizen, I am extremely concerned about this recent ...legislation that has been mishandled in the legislature (not one lawyer sits on the insurance committee responsible for fostering this bill) and is the subject of a false narrative. Contrary to what’s being advertised by misguided legislators and the misinformation campaign of the Chamber of Commerce, this bill does not, will not, and can not help small businesses. If anything it hurts small businesses for a multitude of reasons, not the least of which, is the fact that insurance premiums will skyrocket should this bill pass. Higher insurance rates hurt us all. It’s a small wonder the insurance industry is so excited about the possibility this bill could become law and they’ve poured a heap of money into PAC contributions to push it through. Hurting small businesses, the average citizen, and only helping large insurance companies get richer, is not my idea of good law. If you’ve ever read my biography, you’d probably not be surprised to learn that despite all those issues, the most significant problem with this bill for me is the fact that SB 415 will hurt our veteran military retirees. The current version of Senate Bill 415 not only reduces the amount of damages a veteran military retiree could claim in a personal injury action, it has the potential of resulting in an injured veteran having to pay out of pocket should they bring a claim. I’d bet the Senators and ill-advised citizens who’ve come out in support for this bill don’t even realize all of the ramifications. When the bill was never vetted by anyone other than the insurance industry, how could they? Today, after being hurt for seven years and litigating his case for five years, our client Arthur Smith finally received justice from the hands of a jury in Cob...b County State Court. Art was in a low speed rear end collision that unfortunately resulted in herniated discs in his neck. He has lived through a single level fusion, the continuing pain of his spine injury and the spectre of an impending future surgery. He will continue to live with pain and physical limitations his entire life, but from today on he will rest assured that his family will be provided for. These guys are out dispensing justice and they should be applauded. The same doctor that is the subject of the sanctions here was designated in a case we have going to trial. Before the doctor was even sent the medical records, I was told by the insurer's lawyer how he'd testify against my client. The doc has been paid over $4 million by the same insurer over the years. That insurer has bought and paid for an expert to the extent they know what he'll say before he even has... records to review. $4 million will buy you a lot of testimony.... and it has. This is nothing short of an incredible show of weakness in the House of Representatives. Since when did "conservatives" (using that term very, very loosely) start expanding the powers of the federal government and stripping citizens of each state from their ability to legislate their own citizens? Clearly, many elected representatives remain beholden to the well-funded lobbyists of insurance companies espousing false rhetoric about medical malpractice cases being related to ...increased healthcare costs. The absurdity of that argument and its baseless nature have been revealed time and again, but it keeps re-surfacing simply because it sounds good. Perhaps one of the representatives who voted for this trash would have the audacity to sit down with one of my clients and me, especially one who lost a limb or limbs or the life of a loved one, and tell us both why their injuries are worth so little. The January NHCEF board meeting was spent planning our Spring Shrimp Boil fundraiser and listening to the "wish lists" from our school principals. Each year the... foundation members review proposals for needs at Wauka Mountain, Riverbend, and Mt Vernon elementary schools as well as North Hall middle and high schools. NHCEF requires that funds are used for educational materials that will impact the majority of the student population. Last year NHCEF gave over $41,000 to the five schools.
