The automatic stay is one of the benefits to filing for bankruptcy. When someone files for bankruptcy, the court orders a stay on all attempts to collect debts from the filer. In part, the reason for the automatic stay is to give the filer some breathing room so they can figure out a repayment plan. It also makes the process more manageable for the courts, which do not have to deal with endless modifications to the bankruptcy petition as the filer makes incremental payments throughout the process. The short answer to this question is no, there is no minimum amount of debt necessary to qualify for bankruptcy. However, for Chapter 7 bankruptcy cases, there is a requirement that the filer demonstrate that they do not have sufficient means to pay back their debts through a Chapter 13 bankruptcy. So, practically speaking, it is important that those who are interest in filing for bankruptcy understand the two types if individual bankruptcies, what they entail and the poten...tial impact that a bankruptcy can have on their finances, moving forward. Before someone files for bankruptcy, especially if they do not have a significant amount of debt, it is important they consider the cost of filing for bankruptcy, as well as the effect that filing will have on their life after the bankruptcy is over. However, with that said, the general public’s understanding on the repercussions of filing for bankruptcy are often worse than they actually are. Update on Shelter in Place Order On April 8, 2020, Governor Brian Kemp extended the shelter in place order. The new order runs through April 30, 2020. Also, the public health emergency has been extended until May 13, 2020. While I’m encouraged by some of the recent data, we still have incredible challenges before us, Kemp stated.... Governor Kemp also addressed the issue of Covid-19 spreading into nursing homes. A new executive order requires senior care facilities to take more steps to prevent the spread of the virus, including banning most visitors and requiring in-room dining services. It also mandates the screening of residents for symptoms of the disease, such as fevers and respiratory issues. We are all hopeful that these measures will help to control the spread of the virus and get our lives back to normal. Please stay safe and healthy! https://gov.georgia.gov//executive-o/2020-executive-orders
