Transitional Authority is coming! Bank Mortgage Originators will soon be able to move to high service value added Non-Bank Mortgage companies like Southeast Mor...tgage of Georgia, Inc. easily and without penalty or delay. The playing field is finally a little more even. Almost ten years after the requirement for non-bank MLOs to be licensed by each state in which they want to originate, the SAFE Act has been amended to allow loan originators to move to a non-bank mortgage company and continue to originate prior to receiving a state license. Regulators in all 50 states have amended their laws and rules to allow MLOs up to 120 days to obtain their license(s) after moving from a bank to a non-bank mortgage company. The Transitional Authority to originate allows MLOs to move without the fear of losing customers and referral partners while they take the required education, pass the National exam and submit their application(s) for state license approval. In Georgia, the amended rule is currently in a comment period until Dec 18 with a hearing scheduled by the Department of Banking and Finance for Dec 20.
