When Debt Collectors Call When debt collectors call, it is important to know your rights and what you can do. The Fair Debt Collection Practices Act (FDCPA) makes is illegal for debt collectors to use abusive, unfair, or deceptive practices when attempting to collect a debt. Below are some FAQ’s that may help you understand what debt collectors can and cannot do: What debts can collectors contact me about?... Debt collectors can contact you about credit card debt, auto loans, medical bills, student loans, mortgage, and other household debts. They should not contact you about business debts. When & where can debt collectors contact me? Debt collectors can’t contact you before 8 a.m. or after 9 p.m., unless you agree to it. They also can’t contact you at work if they’re told you’re not allowed to get calls there. How can debt collectors contact me? Debt collectors can call you, or send letters, emails, or text messages to collect a debt. How can I stop a debt collector from contacting me? You can send a letter by mail asking for contact to stop. It is a good idea to keep a copy of the letter and send it by certified mail, so you have a record the collector received it. Once the collector gets your letter, it can only contact you to confirm it will stop contacting you, or to tell you a specific action, like filing a lawsuit, will be taken. Bankruptcy will stop collections actions and will help you eliminate the debt or manage repayment on terms you control. If you are represented by an attorney, and inform the collector, the collector must communicate with your attorney, not you. What are debt collectors not allowed to do? Debtor collectors can’t: threaten you with violence or harm, use obscene or profane language, repeatedly use the phone to annoy you, misrepresent the amount you owe, lie about being attorneys or government representatives, falsely claim you’ll be arrested, or claim legal action will be taken against you if it’s not true, try to collect interest, fees, or other charges on top of the amount you owe (unless the original contract or your state law allows it), deposit a post-dated check early, take or threaten to take your property unless it can be done legally If you are getting contacted by a debt collector, of if you’re ready to learn about your debt-relief options, the team at Coastal Georgia Bankruptcy can help. We offer representation in Chapter 7 and Chapter 13 bankruptcy matters, foreclosure, repossessions, garnishments and debt settlements. Call (912) 271-2724 or visit us at coastalgabankruptcy.com.
