GSRD Wins Fee Award for Client Against HOA for Pursuing Claim Against Homeowner After HOA Had Actual Knowledge of Homeowner's Conveyance of Property to New Owner. Brian E . Daughdrill, a Principal at Giacoma Schleicher Roberts & Daughdrill, LLC, argued that the HOA's receipt of copies of the deeds transferring the home to a new owner and the new owner's actual occupancy of the unit put the HOA on notice even though the deeds were not yet recorded such that their pursuit of cl...aims against the transferring owner needlessly expanded the proceedings and caused unnecessary expenditure of fees because the HOA did not make the Court aware of the deeds. The Court confirmed that Georgia is a race-notice state and that a party seeking to record against a property who is on notice of an earlier conveyance or claim is subject to that claim. Congratulations to Mr. Daughdrill!
