Do you need to have a Will? With most people it is to their advantage to have one. If you die without a Will in the State of Georgia, Georgia statutes provide who will get your property. The persons who inherit under the Georgia statutes may not be the persons you would choose to have your property. For example, if you are married with children and die without a Will, under Georgia law, generally the spouse will take a share of your property, not less than one third of your ...property, but your children will get a share of your property. If your children are not adults, this can make the selling of estate property by the surviving spouse more complicated and may require court approval before there can be a sale of estate property. Most persons seem to prefer that all of their property go to their surviving spouse. Also, having a Will can avoid having to make regular reports to court and avoid having to get court permission to invest estate property in assets or dispose of estate property.
